"Any incident or pattern of incidents of controlling, coercive or threatening behaviour, violence or abuse between those aged 16 or over who are or have been intimate partners or family members regardless of gender or sexuality. This can encompass but is not limited to the following types of abuse:


•psychological •physical  •sexual  •financial •emotional


Controlling behaviour is: a range of acts designed to make a person subordinate and/or dependent by isolating them from sources of support, exploiting their resources and capacities for personal gain, depriving them of the means needed for independence, resistance and escape and regulating their everyday behaviour.


Coercive behaviour is: an act or a pattern of acts of assault, threats, humiliation and intimidation or other abuse that is used to harm, punish, or frighten their victim.”*


*This definition includes so called ‘honour’ based violence, female genital mutilation (FGM) and forced marriage, and is clear that victims are not confined to one gender or ethnic group.


Sexual and domestic violence UK;   in an average year you can expect, (536,000) victims of sexual assault, (2.0 million) of domestic abuse, and (540) homicides. (Reported incidents) Since only about 25% of cases are reported, the statistics are appalling. As a nation we condemn others for the same – instead of condemning other people, the nation and its populous should look to its-self. Only then will the nation and its populous have a right to condemn anyone.

Domestic Violence & Child Abuse are covered by a multitude of statutes. See; http://www.justice.gov.uk/downloads/la-private-matters/dv-ca-offences.pdf  
these procedures/charges unfortunately leave great loopholes in law.
Statute should be created to encompass Domestic Abuse as a recognised charge in law.
Domestic Abuse as a recognised charge, should encompass & recognise all abusive scenarios, sexes, ages & orientations, and encompass all intimate relationships including Marriage Partners & Related Family, All Cohabitee & Non Cohabitee Relationships, All Ages..
Whilst it is appreciated that wording complexities will arise due to the ambiguity of the written word, it can and should be done as a matter of fervour.

A girl who has suffered abuse at the hands of a family member says she does not feel safe to seek help because of the fear that her personal details will be released in court.

The teenager, who has refused to be named for fear of reprisals, said her life has been threatened if she speaks up. She said she is too scared to go to court to seek protection in case her address is revealed during those proceedings, or any subsequent appearances.

Demand that this "dangerous anomaly" in the court system, be addressed.

Some MPs have backed "Eve's law" - named after campaigner Eve Thomas - which would give those who have suffered from domestic abuse an exemption from having to give their addresses when appearing in open court. They also want a marker system to be put in place which would inform the authorities of whose details need to be protected.
They believe the changes would also make it easier for people being abused by their partners to come forward and speak to the police. They acted after the news emerged that many victims of domestic abuse were having to give their addresses when attending court on unrelated matters after their escape.
This, they said, was putting them in danger because it was tantamount to handing their "flee addresses" to their abusers. Others said their addresses were even included on court orders for their protection served on the people abusing them.

Speaking to Channel 4 News, the girl alleged that she was a victim of child sexual abuse and violence at the hands of a close family member. She said: "I want to bring everything out into the open but I don't feel safe enough.
"I am reluctant to go to court or get a new home due to my new address being revealed. Eve's law would keep me safe and thousands others. I ask that this be brought in ASAP to protect me and thousands like me."
She said she would go to the police once she felt safe.

Finding a safe new home
Finding nurseries and schools
Accessing health services
Accessing local community and cultural services
Gaining legal advice including accompanying women to court
Budgeting and welfare benefits
Training, education and employment

Bid to save legal aid; for domestic violence victims.

The government faces a legal challenge to the lawfulness of legal aid reforms which the claimants say prevent domestic violence victims getting financial help in family law cases. The action has been brought by two charities - the Public Law Project and Rights of Women - with the support of the Law Society, which has provided indemnity against adverse costs.
On 1 April the Legal Aid, Sentencing and Punishment of Offenders Act 2012 came into effect removing legal aid for the majority of private family law matters. Accompanying it, the Civil Legal Aid (Procedure) Regulations 2012 introduced criteria making legal aid available for those affected by domestic violence.
However the groups claim the evidential requirements to prove domestic violence are too narrow and exclude many women even where it is clear there has been violence or that there is an on-going risk. The LASPO definition of domestic violence is any incident, or pattern of incidents, of controlling, coercive or threatening behaviour, violence or abuse whether psychological, physical, sexual, financial or emotional between individuals who are associated with each other.
However some of these forms of violence would not fall into the prescriptive evidential requirement. In addition, the evidence provision in many cases has a 24-month time limit and the charities argue that it is too restrictive as perpetrators may remain a lifelong threat.
A survey carried out last year by Rights of Women, Women’s Aid and Welsh Women’s Aid showed that half of all women surveyed who had experienced or were experiencing domestic violence did not have the prescribed forms of evidence to access family law legal aid.
Of those 61% took no action in relation to their family law problem as a result of not being able to get legal aid.
Law Society president Nicholas Fluck said: ‘The LASPO legal aid cuts have resulted in radical consequences for access to justice with the worst impact affecting the poorest and most vulnerable sectors of society.  ‘It is vital that survivors of domestic abuse can bring evidence to satisfy the broader statutory meaning of domestic violence, not the over-strict tests required by the regulations as they now stand.’
*And victims are forced to disclose their “address” when making applications to the courts! “Perpetrators Paradise”!!

Domestic violence against women in the UK has reached "crisis" proportions, according to a hard-hitting report released today. 24/02/15
One in four British women will experience abuse at the hands of a partner during their lives.
The same proportion will be sexually assaulted or raped - normally by someone they know.
 'Culture of tolerance'
 These shocking statistics are being unveiled by human rights charity Amnesty International, which is blaming a "culture of tolerance" for the epidemic of domestic violence.
 It is also calling on the police and Government to drastically improve the way such crimes are investigated and punished. "In the UK violence against women in the family is at crisis point," said Amnesty International secretary general Irene Khan.
 "Behind closed doors and in secret, women are subjected to violence by their partners and close relatives, are too ashamed and afraid to report it and are seldom taken seriously when they do."
Hitting woman 'is okay'
 There were 635,000 incidents of domestic violence in England in 2002 and new figures reveal the extent to which domestic violence is tolerated in Britain. One in three adults: believes hitting a woman is "okay" under certain circumstances.
Amnesty International also points to the poor record of prosecutions for such violent crime.
Less than three out of 10 domestic violence incidents reported to police result in conviction and only one in four are recorded.
Not treated seriously enough
Recent court cases, Ms Khan added, prove that domestic violence is not treated seriously enough.
Andrew Dexter, for example, will serve a minimum of just seven years in jail for the GBH, torture and manslaughter of his girlfriend Sharon Franklin.
The 33-year-old, from Nuneaton, inflicted an appalling catalogue of injuries upon 32-year-old Ms Franklin, who suffered blowtorch burns, 17 skull scars and a collapsed lung. But parole laws mean his two life sentences could see him freed.
Sex trafficking rife
The Amnesty campaign also highlights the crisis in domestic violence across the rest of the world.
Sex trafficking is also rife, with 700,000 women caught up in global prostitution every year.
Myra Johnson, policy chief for UK domestic violence charity Women's Aid said: "In this country alone the statistics are shocking.
"Two women die every week as a result of domestic violence. Our relationship with the police in assisting victims has improved but there is still a long way to go in changing attitudes."
A Home Office spokeswoman said it was working closely with other government departments to "prevent domestic violence happening or recurring, to protect and support its victims, and to bring offenders to justice".
She added that the Domestic Violence, Crime and Victims Bill currently going through Parliament will modernise the law while Home Secretary David Blunkett has assigned £14 million over three years for new projects.
"We propose to strengthen police powers through a string of initiatives, including making common assault an arrest-able offence and criminalising the breach of non-molestation orders."
 And that does not include Child Abuse/Murders!
NOTHING WILL BE DONE ABOUT IT (acceptable collateral damage) UNLESS YOU THE PUBLIC< MAKE SOME SORT OF STAND> SIGN IT:-
YOU hold the POWER to change this country's attitude to abuse.
 YOU hold the power to make the government act.
 IF YOU want to see abuse STOPED in the UK. However drastic you may deem it to be, THIS is the only solution!

YOU! would be the first to say, why: did no one help ME!

That's just the problem: ME! is the only person in YOUR! life!
